Effective January 16, 2026, Hampden Zimmerman has added US Electrical Services d/b/a Electrical Wholesalers of New England as a dealer under the G19 contract.
- All Terms & Conditions contained in the IFB for MC15-G19, the bidder's response to the IFB,
and subsequent negotiation shall carry forward into this contract in their entirety without
exceptions. - Use of the contract is left to the discretion of each respective member. No guarantee of volume has been made to the Suppliers.
- For Suppliers:
- Any purchase order issued to a Supplier by an MHEC member is an agreement between the individual member and the Supplier, not the MHEC organization, or other MHEC Members in part or total. If your organization requires members to enter into a specific statement of work agreements, these agreements may not supersede the MC15-G19 contract terms and conditions.
- Business Review & Benchmark Evaluation: To ensure that this contract remains competitive, periodically, MHEC may compel contracted Suppliers, at their own expense, to engage in a business review meeting and benchmarking exercise. Suppliers will have a mutually agreed upon period typically thirty (30) days) to complete the benchmarking exercise. Once complete MHEC will respond within ten days. The initial benchmark evaluation will be conducted six months after the contract starts to establish a baseline for performance and pricing metrics. Subsequent benchmark evaluations will occur annually thereafter, unless MHEC determines that an interim evaluation is necessary due to significant market changes, contractual concerns or other relevant factors
- Market Basket Refresh: To ensure that the basket(s) stays relevant for technological changes, updates in industry standards etc., the MHEC on a yearly basis may request market basket modifications. Suppliers are expected to actively participate in this process. Non-compliance may impact a supplier's contract award.
- Billing Errors: Periodically, MHEC may request awarded contract holders to conduct a billing audit. Suppliers will be expected, at their own expense, to perform said audit of contractual pricing compliance. If the audit reveals billing errors, the Supplier will be responsible for refunding/issuing a credit memo to the affected member. Members reserve the right to conduct audits, including utilizing third parties. Should the results of the audit find billing discrepancies of over 3% of the contract, the holder shall be responsible for the cost of the audit, in addition to refunding/issuing a credit memo to the affected member. The MHEC, and its Members, will have the ability to look back for a period of three (3) years in order to discover errors.
- Tier II Reporting Requirements: If applicable, Suppliers will be required to submit comprehensive Tier II reports in compliance with the Emergency Planning and Community Right-to-Know Act (EPCRA). Tier II is defined as procurement dollars which are spent with certified diverse businesses, and which ideally can be proportioned, either in absolute dollars or percentage terms, according to the share of Contractors spend that is allocated to the member. The Tier II reports should detail all hazardous chemicals stored or utilized at the supplier's facilities. Suppliers must provide accurate and up-to-date information on the types, quantities, and locations of these chemicals.
- Additional Reporting Requirements: Suppliers may be asked to provide spend reports, furnished in an electronic format, detailing by member, SKU, manufacturer product number, and corresponding price points.
- ESG Reporting: Contracted Suppliers may also be obligated to provide Tier II Diversity spend data and the carbon impact associated with the products and services supplied.
- Service Level Agreements: As a Supplier on the G19 contract, you may be asked to enter into a service level agreement.
- Real Time Inventory capabilities: As a Supplier on the G19 contract, you may be asked about your ability to provide real-time inventory capabilities and/or stock out reporting. The supplier may employ tools such as barcode scanning, RFID, or equivalent tracking systems to ensure that changes in inventory, whether additions, usage, or restocking, are instantly reflected in the inventory management system.
- For Members:
- Some suppliers awarded to this contract may require that members enter into specific
purchase agreements. The MHEC does not vet these agreements. Therefore, members considering entering into these agreement are strongly encouraged to submit these documents to their legal counsel for review. The terms and conditions of those agreements shall not supersede the MC15-G19 contract terms and conditions. - You may be required to use a website, a vendor special code or a participation agreement
to obtain the contract benefits and receive special contract pricing. If this is required, this will be indicated on the individual Suppliers contract. - Prevailing wage rates are subject to change annually. It is the responsibility of the contract holder to request prevailing wage rates from members when performing services where prevailing wages apply.
- This contract contains installation and services which may require public members to obtain separate quotes or bids for installation services.
